Protecting The Electronic Consumer From Cyber Crimes

Authors : Boukais Soumia .

Abstract

This topic examines cybercrimes affecting the electronic consumer within the Algerian legal framework governing e-consumption. It begins by defining the electronic consumer and cybercrime, highlighting their key characteristics. The study then explores major forms of cybercrimes, including electronic fraud, misleading online advertising, and violations of legal obligations. It also explains the legal basis and penalties provided under Law No. 18-05 on e-commerce and other relevant legislation. The findings show that the Algerian legislature has adopted both preventive and deterrent measures to protect electronic consumers by strengthening obligations and imposing sanctions. However, this protection still faces challenges, particularly in terms of enforcement and the difficulty of proof. Therefore, there is a need to enhance practical mechanisms and update the legal framework to keep pace with the rapid evolution of cybercrimes.
