الملخص

الملخص: تعتبر عملية تحقيق التوازن بين متطلبات حماية الاقتصاد الوطني والمصالح الحيوية للدولة الجزائرية من الجرائم الجمركية واحترام مقتضيات المحاكمة العادلة لمرتكبي هذه الجرائم، معادلة صعبة التحقيق بالنظر إلى سعي الدولة الى حماية مصالحها المالية والاقتصادية عن طريق أجهزتها الإدارية ممثلة في إدارة الجمارك التي منحها المشرع آليات قانونية واسعة لممارسة صلاحياتها لاسيما سلطة البحث، التحري والتحقيق، من شأنه المساس بمبادئ المحاكمة العادلة للمتهم في الجريمة الجمركية لاسيما ما ارتبط بالمساس بحقوق الأشخاص وحرياتهم، فالتطبيق الغير متوازن للسلطات الواسعة لإدارة الجمارك في مقابل الضمانات الممنوحة للمتهم من شأنه ان يؤدي الى المساس بحقوق المتقاضين، لذلك وجب إرساء توازن بين متطلبات الفعالية في مكافحة الجريمة الجمركية وحماية وصون حقوق المتهمين وحرياتهم بما يحقق حماية كاملة لمصالح الطرفين. Abstract: The process of achieving a balance between the requirements of protecting the national economy and the vital interests of the Algerian state against customs crimes and respecting the requirements of a fair trial for the perpetrators of these crimes is considered a difficult equation to solve, given the state's efforts to protect its financial and economic interests through its administrative bodies represented by the customs administration, to which the legislator has granted broad legal mechanisms to exercise its powers, particularly the power of investigation. This would undermine the principles of a fair trial for the accused in a customs crime, particularly those related to the violation of individuals' rights and freedoms. The unbalanced application of the broad powers of the customs administration in exchange for the guarantees granted to the accused would undermine the rights of the litigants. Therefore, a balance must be established between the demands for efficiency in combating customs crime and the protection and preservation of the rights and freedoms of the accused in order to achieve full protection of the interests of both parties.
