دور السلطة الوطنية للأمان والأمن النووين في حماية البيئة

الملخص
الملخص: كلّف المشرع الجزائري السلطة الوطنية للأمان والأمن النووين، بالسهر على احترام قواعد الأمان والأمن النووين والحماية من الإشعاعات النووية، وبحماية الأشخاص والممتلكات والبيئة. ومَنحَها من الآليات والصلاحيات ما يوحي بأنها قادرة على القيام بهذا الدور بمقدرة وفعالية. لذلك فإن هدف هذه الدراسة هو الوقوف على مدى فعالية الدور الذي تقوم به هذه السلطة في مجال حماية البيئة. وقد تم التوصل إلى أنه تم إضعاف وتحجيم دور هذه السلطة في هذا المجال بتكريس تبعيتها للسلطة التنفيذية، وبعدم ضمان التشكيلة الجماعية لمجلسها والتخصص العلمي لأعضائها وبعدم تبني نظام العهدة، الذي يضمن استقلالية أعضائها ويحميهم من العزل التعسفي. Abstract: The Algerian legislator has mandated the National Authority for Nuclear Safety and Security to ensure respect of the rules of nuclear safety and security, and protection from nuclear radiation, and to provide protection to persons, property and environment. The authority has been granted mechanisms and powers that suggest that it is able to fulfil this role effectively and efficiently.Thisstudy aims to determine the extent of the effectiveness of the role of this authority in environment protection. The results have shown that the role of this authority has been weakened and limited because of its dependence on the executive authority, lack of collective composition in its council, lack of members with scientific specialization, and lack of a tenure system, which guarantees the independence of its members and protects them from arbitrary dismissal.
