The Legal Responsibility Of Companies Involved In Supporting International Violations: An Analytical Study Of The Possibility Of Prosecuting Them Before National And International Criminal Courts

Abstract
The legal responsibility of companies for supporting international violations present both considerable opportunities and challenges in prosecuting them before national and criminal courts. Despite extensive academic research, many questions remain on whether MNCs can be held fully accountable in case they violate laws and be prosecuted before a national court. Thus, the current study analyses the legal basis of corporate civil and crime liability, presenting the most prominent issue linked to this and assessing the efficacy of national courts. The findings indicated that effective prosecution demands developing stronger international and domestic accountability regimes guided by United Nations (UN) and organization for Economic Cooperation and Development (OECD) standards and recent European Nation initiatives, grounded in human rights, environmental sustainability, and substantive justice. This encompasses making rules clearer regarding corporate legal responsibility, advancing how international standards become part of domestic law, and legally requiring compliance duties.
