The Role Of The Administration In Implementing The Cancellation Rulings

الملخص
The characteristic of the modern state is that it is a state of law that always seeks to enforce what is stipulated by the law. If the relationship between the annulment suit and the principle of legality cannot be denied, because it is considered one of the most important mechanisms through which the administrative judge’s oversight is activated over the decisions of administrative bodies that violate the law, since the litigant, in addition to the ruling in his favor to annul the administrative decision, expects the administration to achieve for him the real benefit of this annulment by implementing it to achieve its legal effects. إن سمة الدولة الحديثة أنها دولة قانون تسعى دائما لفرض ما نص عليه القانون، وإذا كانت العلاقة بين دعوى الإلغاء ومبدأ المشروعية لا يمكن إنكارها، لأنها تعتبر من أهم الآليات التي يتم بواسطتها تحريك رقابة القاضي الإداري على قرارات الجهات الإدارية المخالفة للقانون، ذلك أن المتقاضي بالإضافة إلى الحكم له بإلغاء القرار الإداري فإنه ينتظر من الإدارة أن تحقق له الفائدة الحقيقية من هذا الإلغاء عن طريق تنفيذه لتحقيق آثاره القانونية.
