Family Conflicts In The Central Maghreb Through Al-wansharīsī’s Nawāzil: Marital Relations As A Case Study

Abstract

Nawāzil are considered among the most important sources in Islamic legislation due to their close connection with fatwas related to human life across different periods, whether in matters of transactions or acts of worship. These sources occupied a wide space in addressing social aspects that change over time and place. The Nawāzil of al-Mi‘yār constitute one of these sources, as they compiled various incidents and events in the Islamic Maghreb in general, and the Central Maghreb in particular. In this study, we seek to shed light on one of the social aspects addressed in al-Wansharīsī’s al-Mi‘yār, namely family conflicts in the Central Maghreb through al-Wansharīsī’s nawāzil, with a particular focus on marital relations, given their positive and negative effects on the social structure of society.
