الملخص

يعد الذكاء الصناعي من أكثر الموضوعات استقطابا للجدل القانوني والفقهي والأخلاقي، لما يطرحه من إشكاليات، وما يثيره من مخاوف وهواجس قد تطال الوجود البشري كله على كوكب الأرض. ولما كان الفقه الإسلامي فقها حركيا متجددا مواكبا للتطورات العلمية والتقنية، ولديه الأجوبة والحلول الشرعية المناسبة لكافة النوازل والمستجدات التي تفرزها الحضارة البشرية والتطور العلمي المتسارع، كان لدى هذا الفقه الكثير مما يقوله أو يؤصله في موضوع الذكاء الصناعي وتطبيقاته التي قد تتفق مع أحكام الشريعة الإسلامية السمحة، وقد تتعارض معها في كثير من الأحيان، فجاءت هذه الدراسة لرسم مسار تقنيات الذكاء الصناعي لضبط إيقاعها من خلال وضع الضوابط العامة التي تحدد مسارها وتضبط إيقاعها، حيث توصلت هذه الدراسة إلى جملة من النتائج والتوصيات أودعها الباحث في خاتمة دراسته هذه. Artificial intelligence is one of the most controversial topics in legal, jurisprudential, and ethical circles, due to the problems it raises and the fears and concerns it raises that could affect all of human existence on planet Earth. Since Islamic jurisprudence is a dynamic, renewed jurisprudence that keeps pace with scientific and technological developments, and has the appropriate legal answers and solutions for all the new issues and developments that human civilization and rapid scientific developments produce, this jurisprudence has much to say or establish on the subject of artificial intelligence and its applications, which may agree with the provisions of the tolerant Islamic Sharia, and may often conflict with themوThis study came to chart the path of artificial intelligence technologies to control its pace by setting general controls that determine its path and control its pace. This study reached a set of results and recommendations that the researcher deposited in the conclusion of this study.
