الملخص

تعد العقود المركبة إحدى إفرازات المدنية الحديثة وتداعياتها على المنظومة العقدية في الفقه الإسلامي، خاصة فيما يتعلق بالعقود المستحدثة والمعاملات المالية المعاصرة، وتهدف هذه الدراسة إلى إبراز الأسس والمبادئ التشريعية التي تستند إليها فكرة تركيب العقود والجمع بينها في الفقه الإسلامي، وإبراز أثر تلك الأسس في إضفاء المشروعية على تلك العقود من خلال بيان مفهوم العقود المركبة وسماتها، وبيان الأسس التي تستند إليها هذه العقود، كحرية التعاقد وفقه المخارج الشرعية، والمصلحة والعرف وصولا إلى نتائج البحث والتي من أهمها استناد العقود المركبة إلى الأسس والمبادئ التشريعية التي تم ذكرها في ثنايا الدراسة وتوصياته بإيلاء الباحثين والدارسين جوانب من موضوع الدراسة باهتمامهم البحثي كضوابط العقود المركبة ومقاصدها ومجالاتها وتطبيقاتها المعاصرة. Complex contracts are one of the products of modern civilization and their repercussions on the contractual system in Islamic jurisprudence, especially concerning new contracts and contemporary financial transactions. This study aims to highlight the legislative foundations and principles upon which the idea of combining contracts in Islamic jurisprudence is based. It also aims to highlight the impact of these foundations in legitimizing such contracts by explaining the concept of compound contracts and their characteristics, as well as stating the principles on which these contracts rely, such as contractual freedom, understanding of legitimate exits, interest, and custom, leading to the research results, among the most important, include: the reliance of compound contracts on the legislative foundations and principles mentioned in the study, and recommending researchers and scholars to pay attention to aspects of the study topic in their research, such as the regulations of compound contracts, their objectives, fields, and contemporary applications.
