The integration of blockchain, smart contracts, and AI-driven intelligent agents is transforming legal and economic systems. Smart commercial contracts now extend beyond automated drafting and execution, as intelligent agents can negotiate, analyze data, make decisions, and finalize agreements autonomously on behalf of principals. This development creates significant legal challenges, particularly in determining contractual will, attributing intent, and assigning liability for algorithmic or technical errors. It also raises questions about the evidentiary value of such contracts before courts and the resolution of conflicts of laws in decentralized, cross-border environments. This study explores the role of intelligent agents in shaping smart contracts within the digital economy by examining both theoretical underpinnings and practical applications. It evaluates the suitability of traditional agency principles, potential liability models, and issues of consumer and data protection. Ultimately, the findings highlight the urgent need for a clear legal framework that reconciles innovation with legal certainty to protect contracting parties in the digital age.
