Self-executing Smart Contracts: Technical And Legal Aspects

Abstract

Self-executing smart contracts represent a qualitative advancement in the field of digital transactions, blending advanced technological innovation with legal frameworks to ensure the automatic and transparent execution of agreements while minimizing the need for traditional intermediaries. This article initially addresses the jurisprudential and legislative foundations that contributed to defining these contracts and establishing their legal regulations, then reviews the technical stages of drafting, deploying, and operating them on blockchain networks, with reference to their practical applications in areas such as real estate contracts, smart waqf contracts, and smart insurance. It also discusses the main practical and legal challenges related to technical security and data protection, providing a comprehensive view of the nature of these contracts and their growing role in the contemporary digital economy. تمثل العقود الذكية ذاتية الإبرام والتنفيذ تطورًا نوعيًا في مجال المعاملات الرقمية، حيث تمزج بين الابتكار التقني المتقدم والأطر القانونية لضمان تنفيذ الاتفاقيات تلقائيًا وبشفافية عالية، مع الحد من الحاجة للوسطاء التقليديين، بحيث يتناول المقال في البداية الأسس الفقهية والتشريعية التي ساهمت في تعريف هذه العقود ووضع ضوابطها القانونية، ثم يستعرض المراحل التقنية لإبرامها ونشرها وتشغيلها على شبكات البلوك تشين، مع الإشارة إلى تطبيقاتها العملية في مجالات متنوعة مثل عقود العقارات، وعقود الوقف الذكي والتأمين الذكي، كما يناقش أبرز التحديات العملية والقانونية المرتبطة بالأمان التقني وحماية البيانات، موفرًا رؤية شاملة لطبيعة هذه العقود ودورها المتنامي في الاقتصاد الرقمي المعاصر.
