Abstract: This research examines the extent to which Mudarabah contracts applied by Al Salam Bank Algeria comply with the Shariah requirements set forth in the Mudarabah Standard issued by the Accounting and Auditing Organization for Islamic Financial Institutions. The central problem arises from questioning whether this standard has a guiding influence on the Bank’s contractual practices and whether these contracts fully reflect the principles of Islamic jurisprudence. To address this, the study employed a comparative method between the contractual clauses used by the Bank and the provisions of the standard, alongside a descriptive-analytical approach that involved examining contractual documents and conducting interviews with officials and Shari’ah auditors. The findings indicate that the Bank demonstrates a significant commitment to aligning its financial products with Shari’ah principles and that substantial consistency exists between its Mudarabah contracts and the standard. However, certain crucial aspects, including the treatment of unforeseen circumstances, early termination of contracts, and the distribution of profits in such cases, remain insufficiently articulated, which may affect full compliance with the objectives of the standard. The study emphasizes stricter Shari’ah compliance and wider partnership contracts to strengthen Algeria’s Islamic finance system.
