الملخص
يشهد القضاء تحولات عميقة في ظل التطورات المهولة للذكاء الاصطناعي، والتي يمكن إدماجها في العمل القضائي سواء كأداة مساعدة على اتخاذ القرار، أو باعتبارها أداة يمكنها تسريع الفصل في النزاعات البسيطة وتخفيف عبء التراكم الهائل للقضايا على عاتق القضاة،حيث تهدف هذه الدراسة إلى تسليط الضوء على إمكانية استخدام الخوارزميات في وظيفة القضاء. اعتمدت الدراسة على كل من المنهج الوصفي والتحليلي من اجل عرض الجوانب النظرية للموضوع وتحليل مضامينها. وقد خلصنا من خلال هذه الدراسة إلى أن هذه الأنظمة تفتقر إلى التعاطف الإنساني والفهم العميق لسياق الوقائع، وهو ما قد يؤدي إلى نتائج سلبية، مما يعني أن التدخل البشري لا يمكن الاستغناء عنه،لكن يمكن أن يكون "القاضي الروبوت" حل للنزاعات البسيطة، كما توصلنا إلى ضرورة وضع إطار قانوني دقيق ينظم عملية إدماج الذكاء الاصطناعي يحدد لأدوار والحدود ويضمن تكريسا لمبادئ العدالة والمحافظة على الضمانات القضائية ويمنع انحراف الخوارزميات، الأمر الذي يحفظ التوازن بين التطور التكنولوجي ومتطلبات المحاكمة العادلة. The judiciary is witnessing profound transformations in light of the tremendous developments in artificial intelligence, which can be integrated into judicial work either as a tool to assist in decision-making or as a tool that can accelerate the resolution of simple disputes and alleviate the enormous burden of case accumulation on judges. This study aims to shed light on the possibility of using algorithms in the judiciary function. The study relied on both descriptive and analytical approaches to present the theoretical aspects of the subject and analyze their implications. Through this study, we concluded that these systems lack human empathy and deep understanding of the context of facts, which may lead to negative results, that’s why human intervention cannot be dispensed with. However, the "robot judge" can be a solution for simple disputes. We also concluded that it is necessary to establish a precise legal framework that regulates the process of integrating artificial intelligence, defines roles and boundaries, ensures dedication to the principles of justice and preservation of judicial guarantees, and prevents algorithmic deviation. This preserves the balance between technological development and the requirements of fair trial.
