مساءلة الموظف العام عن تعطيل تنفيذ الأحكام القضائية الإدارية الصادرة ضد الإدارة في الأنظمة السعودية

الملخص
بالنظر إلى أهمية تنفيذ الأحكام القضائية الإدارية الصادرة ضد الإدارة، خاصة من زاوية استحقاقات استقلالية القضاء، وحق المتقاضي في اللجوء إلى العدالة، وإلى جانب إصدار نظام خاص بإجراءات التنفيذ الجبري من خلال محكمة التنفيذ السعودية، هناك ضمانات إضافية تدعم تلك الإجراءات، تتمحور حول المساءلة الشخصية للموظف العام المتهم بتعطيل تنفيذ الأحكام القضائية، وهي مساءلة تكتسي أهمية بالغة، من حيث فاعليتها من جهة، ومن حيث تميز الأنظمة السعودية على هذا المستوى، مقارنة بعديد القوانين المقارنة، من جهة أخرى. هذا التميز واضح من خلال تعدد أشكال المساءلة، بين القضائية وغير القضائية، وتنوع آثارها القانونية، ولكنها في المجمل تؤسس لحلول جيدة تضمن، إلى حد ما، تنفيذ الاحكام القضائية الصادرة ضد جهة إدارية تتمتع بامتيازات السلطة العامة وبنوع من الحصانة التي تنحرف أحيانا في التمسك بها. وعلى العديد من إيجابياتها، فهذه المساءلة تطرح بعض التساؤلات التي تعبر عن بعض جوانب القصور والضعف، والتي تحتاج مراجعات لتكون الفاعلية العملية في أعلى درجاتها. Given the importance of implementing administrative judicial rulings issued against the administration, especially from the perspective of the entitlements of judicial independence and the right of the litigant to resort to justice, in addition to issuing a special system for coercive enforcement procedures through the Saudi Enforcement Court, there are additional guarantees that support these procedures and revolve around the personal accountability of the public employee accused of obstructing the denial of judicial rulings It is an accountability that is of great importance in terms of its effectiveness on the one hand and in terms of distinguishing Saudi regimes at this level compared to many comparative laws on the other hand. This distinction is evident in the multiplicity of forms of accountability, between judicial and non-judicial, and the diversity of their legal effects. However, overall, they establish sound solutions that ensure the denial of judicial rulings issued against an administrative body that enjoys the privileges of public authority and a type of immunity that it sometimes deviates from. Despite its many positives, accountability raises some questions that express some shortcomings and weaknesses that need to be reviewed in order for practical effectiveness to be at its highest levels.
