ملخص: تتناول هذه الدراسة الآلية القانونية لوقف تنفيذ القرارات الصادرة عن مجلس المنافسة في التشريع الجزائري، باعتبارها استثناءً على القاعدة العامة التي تقضي بأن الطعن لا يوقف التنفيذ، حيث تهدف هذه الدراسة إلى تسليط الضوء على التوازن الذي يحاول المشرع تحقيقه بين فعالية ضبط السوق وحماية حقوق المتعاملين الاقتصاديين من الأضرار الجسيمة التي قد تلحق بهم جراء التنفيذ الفوري للقرارات، ومن خلال تحليل نص المادة 63 من قانون المنافسة والنصوص ذات الصلة، يستعرض البحث الشروط الموضوعية والإجرائية المطلوبة لقبول طلب وقف التنفيذ أمام مجلس قضاء الجزائر (الغرفة التجارية)، كما يبحث في السلطة التقديرية للقاضي الاستعجالي في تقييم "الضرر غير القابل للإصلاح" و"الجدية في الطعن"، وتوصلت الدراسة إلى أن تفعيل هذه الآلية يعد ضمانة قضائية أساسية لحماية الاستثمار، رغم التشدد الذي قد يطبعه القضاء للحفاظ على النظام العام الاقتصادي. This study examines the legal mechanism for staying the execution of decisions issued by the Competition Council under Algerian legislation, as an exception to the general rule that appeals do not suspend execution. The study aims to highlight the balance the legislator seeks to achieve between the effectiveness of market regulation and the protection of economic operators' rights against serious damage resulting from immediate enforcement. By analyzing Article 63 of the Competition Law and related provisions, the research reviews the substantive and procedural conditions required to accept a stay of execution request before the Algiers Court (Commercial and Maritime Chamber). It also explores the discretionary power of the summary judge in assessing "irreparable harm" and the "seriousness of the appeal." The study concludes that activating this mechanism serves as a fundamental judicial guarantee for investment protection, despite the stringency sometimes applied by the judiciary to maintain economic public order.
