مقدمات تنفيد الأحكام والقرارات الجزائية في التشريع الجزائري / Introductions To The Execution Of Criminal Judgments And Decisions In Algerian Legislation

الملخص

بعد صدور الأحكام والقرارات الجزائية من المحاكم والمجالس القضائية وقبل الوصول الى مرحلة تنفيذ منطوق الحكم أو القرار الجزائي تتولى النيابة العامة القيام بالعديد من الإجراءات التي تعتبر مقدمات للبدء في التنفيذ وذلك باعتبارها الجهة المشرفة على تنفيذ العقوبات الجزائية وتستعين في ذلك بمصلحتين هما مصلحة تنفيذ العقوبات ومصلحة التحصيل حيث يتولى أمناء الضبط بالمصلحتين السهر على القيام بالإجراءات التي تصل بالحكم أو القرار الجزائي الى مرحلة التنفيذ الفعلي وتختلف هذه الإجراءات حسب نوع الحكم الصادر من الجهات القضائية وتتولى مصلحة التنفيذ القيام بتبليغ الأحكام والقرارات الجزائية وتشرع بعدها في القيام بإصدار الوثائق المتعلقة بالبدء في التنفيذ من خلال اصدار البطاقة رقم 01 واعداد صورة قرار نهائي للحبس وملخص المالية. After the issuance of criminal judgments and decisions by the courts and judicial councils and before reaching the stage of executing the operative part of the judgment or criminal decision, the Public Prosecution undertakes many procedures that are considered introductions to the start of execution, as it is the body supervising the execution of criminal penalties. It seeks the assistance of two departments, namely the Penalty Enforcement Department and the Collection Department, where the clerks of the two departments oversee the implementation of the procedures that bring the criminal judgment or decision to the stage of actual execution. These procedures differ according to the type of judgment issued by the judicial authorities. The Enforcement Department undertakes to notify the criminal judgments and decisions and then proceeds to issue documents related to the start of the execution by issuing Card No. 01 and preparing a copy of the final decision of imprisonment and a financial
