The Constitutional Court: Between Conformity Control And Constitutional Control In Amending The Constitution (2020).

Abstract

The 2020 amendment to the Algerian Constitution enshrined the review of the constitutionality of laws and changed the body responsible for this function to the Constitutional Court. The Constitutional Court was granted several powers, including the monitoring of the constitutionality of laws ranging from optional to mandatory constitutional oversight. The latter includes mandatory compliance oversight, which the constitutional founder required the President of the Republic to notify. لقد كرس تعديل الدستور الجزائري لسنة 2020 الرقابة على دستوريه القوانين مع تعديل في الهيئة التي تتولى هذه الصلاحية وهي المحكمة الدستورية، حيث منح لها عدة صلاحيات ،بالإضافة الى الرقابة على دستورية القوانين التي تتراوح بين الرقابة الدستورية الاختيارية و الرقابة الدستورية الاجبارية، و رقابة المطابقة الإجبارية التي ألزم المؤسس الدستوري رئيس الجمهورية فيها بالإخطار.
