الملخص

يتناول المقال مسألة الشرعية الدولية للتدخل الإنساني في ضوء قواعد القانون الدولي المعاصر، مبرزًا الإطار القانوني والسياسي الذي يحدد تدخل المجتمع الدولي لحماية حقوق الإنسان. اعتمد الباحث المنهج التحليلي الوصفي لتوضيح تطور مفهوم السيادة في مقابل الالتزامات الدولية. أظهرت النتائج أن التدخل الإنساني يثير تعارضًا بين مبدأ عدم التدخل ومتطلبات حماية الكرامة الإنسانية، وأن القانون الدولي يسعى إلى تحقيق توازن بين السيادة والحقوق الأساسية. خلصت الدراسة إلى أن التدخل لا يكون مشروعًا إلا ضمن شرعية أممية وضوابط قانونية دقيقة. Abstract: This article addresses the issue of international legitimacy of humanitarian intervention in light of contemporary international law, highlighting the legal and political framework governing the international community’s role in protecting human rights. The researcher adopted the descriptive-analytical method to clarify the evolution of the concept of sovereignty in contrast with international obligations. The findings revealed that humanitarian intervention creates a tension between the principle of non-interference and the imperative of protecting human dignity, while international law seeks to strike a balance between state sovereignty and fundamental rights. The study concludes that intervention is lawful only within a clear UN mandate and under precise legal conditions.
