التعليل بقواعد الضرر من خلال كتاب البهجة في شرح التحفة لأبي الحسن التّسولي (ت1258هـ)

الملخص
ملخص: الحمد لله وحده والصلاة والسلام على من لا نبي بعده وعلى آله وصحبه ومن تبعهم بإحسان إلى يوم الدين أمَّا بعدُ: فـإنَّ هذا البحث يتطلعُ إلى كشف اللثام عن جانب من جوانب التَّعليل الفقهي عند المالكية، من خلال توظيف القواعد الفقهية التي اشتُهر المالكية بإيرادها في مصنفاتهم إما تأصيلا أو تطبيقًا لها في مختلف الفروع والفتاوى، وذلك بإبراز منهج التّسولي في التعليل بقواعد الضرر من خلال كتابه البهجة في شرح التحفة-تحفة الحكام المعروف بالعاصمية- لمحمد بن عاصم. وقد اشتمل البحث على مقدمة وثلاثة مباحث وخاتمة، حيث افتتح المبحث الأول بترجمة مختصرة لصاحب الكتاب(الشارح) وبتعريف للكتاب ومنهج الشارح فيه، أما المبحث الثاني فقد تعرض لمفهوم التعليل بقواعد الضرر ومجالات إعماله، أما المبحث الثالث فقد تناول الجانب التطبيقي للتعليل بقواعد الضرر بتقديم نماذج مستخرجة من البهجة، واختتم البحث بذكر أهم النتائج وبعض التوصيات. Summary: Praise be to Allah alone and peace and blessings be upon the one after whom there is no prophet, and upon his family, companions, and those who follow them with excellence until the Day of Judgment. This research aims to uncover an aspect of the jurisprudential reasoning of the Maliki school by employing the jurisprudential rules for which the Malikis are famous, either in their foundational texts or in their application to various branches and fatwas. It highlights al-Tasuli’s method of reasoning with the rules of harm in his book "Al-Bahjah fi Sharh al-Tuhfah" - a commentary on "Tuhfat al-Hukkam" known as Al-'Asimiyah by Muhammad ibn Asim. The research consists of an introduction, three sections, and a conclusion. The first section begins with a brief biography of the author (the commentator) and a definition of the book along with the commentator's methodology. The second section discusses the concept of reasoning with the rules of harm and its areas of application. The third section addresses the practical aspect of reasoning with the rules of harm by presenting examples extracted from Al-Bahjah. The research concludes by mentioning the main findings and some recommendations.
