This study explores the roots of constitutionalism and constitutional reform in Mauritania, from the emergence of the constitutional idea to the beginning of constitutional reforms. In addition to defining the meanings of constitution, constitutionalism, constitutionalization, and constitutional reform, and their applications in the Mauritanian context, it also seeks to dissect the process of constitution-making by examining the role of the original constituent power in drafting the constitution, as well as the secondary power in revising it, and the impact of both on the constitutional document, whether in terms of its content, legitimacy, or effectiveness. The study places particular emphasis on the concept of constitutionalism, in order to explore the philosophical and legal foundations of the modern state, as one of the manifestations of the rule of law within the realm of positive law, especially constitutional law. The study argues that constitutionalism has a parallel in the Islamic tradition, namely the sovereignty of Sharia in Islam, when Muslim societies, including both rulers and subjects, were fully bound by its rulings in all aspects of life. Building on this, the study addresses a central question: To what extent has constitutional reform in Mauritania contributed to establishing genuine constitutionalism? It assumes that the political, social, and economic transformations in Mauritania since the 1990s have contributed to the development of the Mauritanian constitutional experience, in line with a gradual reform approach.
