التحكيم عبر الأنترنت : آلية تفرضها خصوصيات منازعات التجارة الالكترونية

الملخص
ملخص: شهدت التجارة الإلكترونية تطورًا هائلًا وانتشارًا واسعًا على الصعيد العالمي، ما رافقه ظهورٌ متزايد لمنازعات تتميّز بخصوصيات فريدة، أبرزها طابعها العابر للحدود، واعتمادها على الأدلة الرقمية، وحاجتها إلى حلول سريعة ومرنة. وقد بيّن هذا الواقع قصور القضاء التقليدي عن مجاراة إيقاع هذه النزاعات، سواء من حيث البطء الإجرائي أو غياب الاختصاص التقني أو صعوبة تطبيق الأحكام عبر الحدود. ومن هنا برزت الحاجة الملحة إلى آليات بديلة لتسوية المنازعات، يتصدّرها التحكيم عبر الإنترنت كوسيلة فعّالة تتماشى مع طبيعة البيئة الرقمية. ويتميّز هذا النوع من التحكيم بقدرته على خفض التكاليف، وتسريع الفصل في الخلافات، وتمكين الأطراف من اختيار محكمين ذوي خبرة في المجال التقني. ومع ذلك، يواجه تحديات تتعلّق بضمان الشفافية، وحماية الخصوصية. وعليه، فإن نجاحه كأداة حديثة لحل النزاعات يتطلّب دعمه بإطار قانوني وتقني يضمن نزاهته وفعاليته في ظلّ الاقتصاد الرقمي المتسارع E-commerce has undergone extraordinary growth and widespread global expansion, giving rise to an increasing number of disputes characterized by unique features—most notably their cross-border nature, reliance on digital evidence, and demand for swift and flexible resolution mechanisms. This reality has exposed the inadequacy of traditional judicial systems in keeping pace with such disputes, whether due to procedural delays, lack of technical expertise, or difficulties in the cross-border enforcement of judgments. Consequently, there is an urgent need for alternative dispute resolution (ADR) mechanisms, with online arbitration emerging as a particularly effective method aligned with the dynamics of the digital environment. Online arbitration is distinguished by its capacity to reduce costs, expedite the resolution of disputes, and enable parties to select arbitrators with specialized technical competence. Nevertheless, it faces significant challenges concerning the guarantee of procedural transparency and the protection of privacy. Accordingly, its success as a modern dispute resolution tool requires robust legal and technological safeguards to ensure its integrity and effectiveness within the rapidly evolving digital economy
