المسؤولية الجزائية للمستشفيات الخاصة عن اجراء عمليات نزع وزرع الأعضاء البشرية في التشريع الجزائري

الملخص
نظم المشرع الجزائري نزع وزرع الأعضاء البشرية وفق شروط وضوابط حددها المشرع في قانون الصحة 18-11،حيث يجب التقيد بها سواء من قبل المؤسسات الاستشفائية او الطاقم الطبي، وهذا نظرا لصعوبة العمليات وتعقيدها، وكذلك من اجل حماية جسم المريض والمتبرع، ورغم ان المستشفيات الخاصة أصبحت تضاهي المستشفيات العمومية من حيث المعدات والأطباء المتخصصين، الا ان اجراء عمليات نزع وزرع الأعضاء يقتصر على المستشفيات العمومية والمرخص لها بهذه العمليات فقط، واي تجاوز لهذا الشرط من طرف أي مؤسسة سيؤدي الى المساءلة الجزائية عن جريمة نزع وزرع الأعضاء في مؤسسة غير مرخص لها، : Abstract: The Algerian legislator has organized the removal and transplantation of human organs according to the conditions and controls specified by the legislator in Health Law 18-11, which must be adhered to by both hospital institutions and medical staff, due to the difficulty and complexity of the operations, as well as in order to protect the body of the patient and the donor. Although private hospitals have become comparable to public hospitals in terms of equipment and specialized doctors, the procedure of removing and transplanting organs is limited to public hospitals licensed to perform these operations only, and any violation of this condition by any institution will lead to criminal accountability for the crime of removing and transplanting organs in an unlicensed institution.
