حـل المجـالس الشعـبيـة البلديـة في التشريع الجـزائري

الملخص
ملخص: يتناول هذا المقـال النّـظام القـانوني لحـل المجـالس الشعـبِيـة البَـلديـة بالجـزائر، وذلك من خِـلال دراسة قَـوانِيـن الجمـاعات الإقليميـة التي حكمت المجـالس البَـلديـة المنتخبـة والإطلاع على تطـور النّـظام القـانوني لحـلها، حيث أن حـل المجـالس الشعـبِيـة البَـلديـة أخطر مظهر من مظاهر الرَّقـابـة الإِداريـة التي تملكها السّـلطـة المَـركزيـة في مواجـهة المجـالس الشعـبِيـة البَـلديـة بالنظر إلى الآثـار المترتبـة عن حـلها. الكلمـات المفتاحيـة: الانتـخابات؛ الإنـسداد؛ البَـلديـة؛ الرَّقـابـة الإِداريـة؛ الرَّقـابـة الوصـائـيـة؛ المجلـس الشعـبِي البَـلدي. Abstract : This article deals with the legal system for dissolving Algeria's municipal people's councils by examining the laws of the regional communities governed by the elected municipal councils and familiarizing themselves with the evolution of the legal system for dissolving them. The dissolution of municipal people's councils is one of the most serious manifestations of administrative control by the central authority vis-à-vis municipal people's councils, given the implications of their dissolution. Résumé : Cet article traite du système juridique de dissolution des conseils populaires municipaux algériens en examinant les lois des communautés régionales gouvernées par les conseils municipaux élus et en se familiarisant avec l’évolution du système juridique de dissolution. La dissolution des conseils populaires municipaux est l’une des manifestations les plus graves du contrôle administratif exercé par l’autorité centrale sur les conseils populaires municipaux, compte tenu des conséquences de leur dissolution.
