The New Provisions In The Two- Degree Litigation Process Before The Administrative Judiciary In The Law22.13

Authors : Dahel Wafia .

Abstract

Two-degree litigation is one of the most important principles required for a fair trial, without distinction between ordinary and administrative courts. This prompted the Algerian legislator to establish administrative courts of appeal, after judgments were previously appealed before the Council of State, which impacted its mission to unify judicial precedent. The research problem revolves around the extent to which the Algerian legislator has succeeded in implementing this principle in light of the legal reforms that began in 2020. It was concluded that despite the positive transformation and the benefits achieved, the legislator still has some work to improve in order to properly implement the principle of two-degree litigation.
