الملخص
الملخص: إن متعهد النقل الدولي متعدد الوسائط للبضائع هو كل شخص طبيعي أو معنوي يتولى القيام بتنظيم ونقل البضائع، بواسطة وسائل نقل مختلفة، سواء قام بعملية النقل بنفسه أو بواسطة ناقلين آخرين، بمقتضى مستند نقل واحد يشتمل جميع مراحل النقل، ويكون مسؤولا عما يلحق البضائع من هلاك أو تلف أو تأخير في تسليمها في الميعاد المحدد في الاتفاق، ويتخذ ثلاثة أشكال قانونية( متعهد النقل الدولي ملاك للسفن، ومتعهد النقل الدولي غير ملاك للسفن، ومتعهد النقل الدولي لا يمتلكون أي وسيلة النقل ). وعليه فمسؤولية متعهد النقل الدولي مسؤولية عقدية من حيث الطبيعة، وتخضع للقواعد العامة في أحكام الالتزام ، تقوم على أساس الخطأ المفترض أو الإهمال. وبالتالي فمسؤوليته تهدف إلى تحقيق التوازن بين مصالح الأطراف وحماية حقوق الشاحن والمرسل إليه، مع ضمان كفاءة النقل الدولي وفقا للقوانين والاتفاقيات الدولية المعتمدة. كما يمكن أن يعفى من المسؤولية إذا أثبت أن الخطأ الذي صدر منه كان بالسبب الأجنبي. Abstract: The international multimodal carrier of the goods is any natural or moral person who organizes and transports the goods by various means of transport, whether the transport is carried out by itself or by other carriers under a single transport document encompassing all stages of transport, responsible for loss, damage or delay in delivery of goods within the deadline specified in the agreement, and taking three legal forms (The international transport contractor is a shipowner, the international transport contractor is a non-shipowner and the international transport contractor has no means of transport). Thus, the contractor's liability is contractual in nature and is subject to the general rules of the provisions of the obligation, based on presumed error or negligence. Its responsibility is therefore aimed at balancing the parties' interests and protecting the rights of the shipper and the consignee, while ensuring the efficiency of international transport in accordance with the international laws and conventions adopted. It may also be relieved of liability if it proves that the error was caused by the foreign cause.
