Direct negotiation constitutes one of the mechanisms through which public procurement contracts may be concluded without a formal call for competition. These cases are expressly defined in Article 41 of Law No. 23-12, which authorizes the administration to negotiate directly with contracting operators and to select the most advantageous offer without following the procedures required under the call for tenders process. This method is considered exceptional in the conclusion of public contracts, as it grants the contracting authority broad discretionary powers and enables it to bypass all the procedures ordinarily mandated by public procurement law, whether in terms of contract conclusion, implementation, or oversight.
