الملخص

یعتبر الوقف عقداً تبرعیاً لحق عیني؛ فهو بذلك يتمتع بالشخصية القانونية، سواء من حيث وجوده وكیانه المستقل، أو من حيث تشابهه مع بعض العقود الأخرى التي تنشأ بالإرادة المنفردة. كما يحظى الوقف بحماية قانونية خاصة تكفل استمراريته وتصون أغراضه من أي اعتداء قد يطاله. وبناءً على ذلك، ترمي هذه الدراسة إلى إبراز مبررات استثمار العقارات الوقفية، من خلال التعريف بالوقف وإظهار خصائصه المستمدة من الأحكام الفقهية، فضلاً عن توضيح الخصائص القانونية ذات المقاصد الشرعية التي تؤهله ليكون من بين العقارات القابلة للاستثمار، في ظل ما يتمتع به من ضمانات كالرسمية والشخصية الاعتبارية. A waqf is considered a donation contract for a specific right; as such, it enjoys legal personality, both in terms of its existence and independent entity, and in terms of its similarity to other contracts that arise from individual will. A waqf also enjoys special legal protection that ensures its continuity and safeguards its purposes from any infringement that may affect it. Accordingly, this study aims to highlight the justifications for investing in waqf real estate by defining waqf and demonstrating its characteristics derived from jurisprudential rulings, as well as clarifying the legal characteristics with legitimate purposes that qualify it to be among the real estate eligible for investment, in light of the guarantees it enjoys, such as official and legal personality
