The Problematic Nature Of The Victim’s Role In Criminal Proceedings

Authors : Bouselsal Noureddine . Lankar Mahmoud .

Abstract

This study seeks to examine the role of the victim in criminal proceedings by investigating the definition established in Algerian legislation and juxtaposing it with the terminology used in both criminal and special laws. The primary issue pertains to the uncertainty in ascertaining the victim's status and rights, regardless of whether the victim is direct, indirect, or a legal entity. The results show that the Algerian lawmaker has given the victim a big role, such as letting them start a public prosecution, become a civil party, and take part in the case. The action's two goals—getting money and helping to find the truth—have made the victim's position unclear. This means that the guarantees of a fair trial need to be more precise.
