الأساس القانوني للمسؤولية المدنية عن أضرار الذكاء الاصطناعي

الملخص
تعتبر قواعد المسؤولية المدنية من بين أهم المواضيع التي لا تزال محل دراسات فقهية عديدة قديما وحديثا. ويرجع ذلك إلى طبيعة هذه القواعد، والتي تعنى بمواجهة المخاطر التي قد يتعرض لها أفراد المجتمع، وتعويض المضرور تعويضا عادلا يجبر ضرره. وتعد مسألة الأضرار الناجمة عن استخدام الذكاء الاصطناعي من أهم المواضيع التي تحظى في الوقت الراهن بالدراسات الفقهية والقانونية بصفة عامة. ويرجع ذلك إلى الانتشار الرهيب لأنظمة الذكاء الاصطناعي؛ إذ أصبح حقيقة لا يمكن المفر عنها، فوجب بناء عليه التعامل معها، ومحاولة إيجاد حلول للإشكالات القانونية المترتبة عنها. ولعل من أهم الإشكالات التي تواجه الباحثين في هذا الموضوع هو مسألة تحديد الأساس القانوني للمسؤولية المدنية عن أضرار الذكاء الاصطناعي. وقد جاءت هذه الدراسة بغرض بيان مختلف الأسس القانونية لقواعد المسؤولية التي يمكن الاستناد عليها كأساس للمسؤولية المدنية عن فعل الذكاء الاصطناعي. This research examines the rules of civil liability, which remain among the most important topics extensively studied in both classical and contemporary jurisprudence. This importance stems from the nature of these rules, which aim to address the risks that members of society may face and to provide just compensation to the injured party to redress the harm suffered. The issue of damages resulting from the use of artificial intelligence has recently become a major focus of legal and jurisprudential studies. This is due to the rapid and widespread proliferation of AI systems, which have become an unavoidable reality. Consequently, it is necessary to engage with these systems and seek solutions to the legal challenges they pose. One of the key challenges faced by researchers in this area is determining the legal basis for civil liability for damages caused by artificial intelligence. This study aims to clarify the various legal foundations of liability rules that can serve as the basis for civil responsibility for acts performed by artificial intelligence.
