مبدأ الحيطة: توجه مستحدث للمسؤولية الناشئة عن أضرار أنظمة الذكاء الاصطناعي.

الملخص
الملخص: تبحث هذه الدراسة في مبدأ الحيطة كبعد جديد لقيام المسؤولية المدنية الناشئة عن أضرار نظم الذكاء الاصطناعي، والتي تقوم بمفهومها التقليدي على أساس جبر الضرر عن طريق تعويض المضرور، غير أنّه بتطور نظم الذكاء الاصطناعي وتعقيدها ظهرت أضرار ومخاطر مرتبطة بغياب اليقين تتعذر توقعها وتقييم مدى جسامتها، فكان من الضروري القول بتفعيل مبدأ الحيطة الذي يرتكز على استباق وتوقع المخاطر، ومن ثم اتخاذ التدابير والاحتياطات اللازمة لتفديها أو الحد منها لذا تعرضنا بنوع من التفصيل لمفهومه والشروط التي يقوم عليها، إضافة إلى جوانب تكريس هذا المبدأ في التشريع الجزائري، وايضاح أثره على قواعد المسؤولية التقليدية، وأخيرا تطبيقه على المسؤولية الناشئة عن أضرار الذكاء الاصطناعي. Abstract: This study aims to shed light on the principale of précaution as a new dimension to the establishment of civil liability arising from damage to artificiel intelligence systèmes, which in its traditional concept is based on reparation of damage by compensating the injured person. However, with the development and complexity of artificial intelligence systems, damages and risks associated with the absence of certainty have emerged that are difficult to anticipate and evaluate. The extent of its seriousness, it was necessary to say the activation of the principle of precaution, which is based on anticipating and anticipating risks and then taking the necessary measures and precautions to avoid or limit them. Therefore, we presented in some detail its concept and the conditions on which it is based, in addition to the aspects of enshrining this principle in Algerian legislation and clarifying its impact on the rules. Traditional liability and finally its application to liability arising from artificial intelligence damages.
