التنوع المذهبي في قانون الأسرة الجزائري- رؤية في الإشكالات والحلول-

الملخص
.لا شك أن معظم نصوص قانون الأسرة الجزائري مستمدة من الشريعة الإسلامية، وغلب فيها المذهب المالكي على غيره من المذاهب الأخرى، مما يوحي بأن المشرع اعتمد هذا المذهب كمرجعية دينية وطنية لقانون الأسرة الجزائري، مع اللجوء عند الضرورة إلى آراء فقهاء المذاهب الأخرى، وهذا ما نتج عنه تنوع مذهبي واضح أدى إلى إثارة عدة إشكالات قانونية في تطبيق نصوص قانون الأسرة الجزائري جاءت نتيجة غموض الإحالة إلى الشريعة وتعدد مصادر الاستناد وغيرها الإشكالات المذكورة في ثنايا البحث، وقد تمت الإشارة في هذه الدراسة إلى بعض الحلول والاقتراحات لمعالجة هذا الإشكالات في نصوص قانون الأسرة وعلى رأسها إعادة النظر في بعض النصوص ولا سيما المادة 222، من خلال وضع إطار مرجعي واضح يحدد ترتيب مصادر الاستدلال، وإنشاء هيئات فقهية استشارية مرافقة للعمل القضائي، وتوفير أدوات علمية تساعد على ضبط المصطلحات الفقهية وتوحيد تفسيرها. There is no doubt that most of the texts of Algerian family law are derived from Islamic law, and the Maliki school of thought prevails over other schools of thought, which suggests that the legislator adopted this school of thought as a national religious reference for Algerian family law, while resorting, when necessary, to the opinions of jurists of other schools of thought This resulted in a clear sectarian diversity that led to the emergence of several legal problems in the application of the texts of the Algerian Family Law, which came as a result of the ambiguity of the reference to Sharia and the multiplicity of sources of reliance and other problems mentioned in the research. In this study, some solutions and suggestions were pointed out to address these problems in the texts of the Family Law, most notably the review of some texts, especially Article 222 By establishing a clear frame of reference that determines the order of sources of reasoning, establishing advisory jurisprudential bodies accompanying judicial work, and providing scientific tools that help control jurisprudential terminology and unify its interpretation.
