القطر البحري على ضوء القانون البحري الجزائري

الملخص
تحتاج السفينة سواء أثناء الدخول إلى الميناء والرسو فيه وكذا الخروج منه أو حتى في عرض البحر إلى الاستعانة بقوة محركة خارجية توفرها لها سفينة أخرى مجهزة فتقوم بجرها في مقابل أجر معلوم، فتسمى حينئذ السفينة الأولى بالمقطورة والثانية بالقاطرة ويتم ذلك في إطار عقد يسمى عقر القطر البحري يكون الهدف منه ضمان أمن الملاحة البحرية تفاديا لوقوع أضرار. إن هدف هذا البحث يتمثل في تسليط الضوء على النظام القانوني للقطر في القانون البحري الجزائري وكذا القوانين المقارنة متى وجدت اختلافات جوهرية وذلك ونظرا لعدم وجود اتفاقيات دولية تخص هذا الموضوع. ولقد خلصت الدراسة إلى التوصل لجملة من النتائج لعل أهمها: أهمية هذا النوع من العقود البحرية المزدوجة سواء للسفينة أو الميناء، تدعيم فكرة الذاتية التي يتميز بها القانون البحري. A ship, whether entering, berthing at, or departing from a port, or even while navigating the high seas, may require the assistance of an external source of propulsion provided by a specially equipped vessel. This assisting vessel undertakes the towage operation in exchange for an agreed remuneration. In such cases, the vessel being towed is referred to as the tow, while the assisting vessel is known as the tug. The relationship between the parties is governed by a maritime towage contract, the primary objective of which is to ensure the safety of navigation and to prevent potential maritime incidents. This study aims to examine the legal regime applicable to towage under Algerian maritime law, with reference to comparative legal systems where substantive divergences exist. This analysis is particularly pertinent given the absence of international conventions specifically regulating towage operations. The research yields several key findings, most notably: the dual significance of this category of maritime contract for both vessels and port operations; and the reinforcement of the principle of autonomy that characterises maritime law as a distinct legal domain.
