معيارية التدخل العسكري الانساني والتطور نحو مسؤولية الحماية.

الملخص
أثار التدخل العسكري الانساني كثيرا من الجدالات حول قانونيته، وأخلاقيات إستخدام القوة العسكرية إستجابة لإنتهاكات حقوق الإنسان، مقابل التنازل عن سيادة الدول، لكن الإستخدام المتكرر له في الآونة الأخيرة وتطبيقه بشكل إنتقائي أدى الى إخراج الفكرة عن منحاها القانوني والشرعي، فكان المساس بالإنسانية والأمن الجماعي بشكل يفوق الحماية التي يكفلها للدولة المتدخل فيها. ولعل المعايير المعتمدة وتطلعات الوحدات السياسية وصناع القرار فيها مع تدخلها بشكل اذعاني كان لها الأثر الرئيسي السلبي على حماية الأمن والسلم في الدول المتدخل فيها، وبالتالي الإخلال بمستويات مسؤولية الحماية، التي كان من المفروض أنها تسعى حسب إدعائها إلى تحقيقها إستنادا إلى ما سمته بالممرات الآمنة، وهذا ما سنوضحه من خلال هذه المداخلة انطلاقا من البحث في مسألة تحكم الظروف الوطنية والدولية في تحديد المعايير المعتمدة للتدخل الدولي الإنساني والبحث في إنعكاسها في تحديد مستويات مسؤولية الحماية. الكلمات المفتاحية: النزاع المسلح، الأمن الجماعي، التدخل العسكري الإنساني، السيادة، الحق في الحماية، المنظمات الإقليمية. The humanitarian military intervention raised many controversies about its legality, and the ethics of using military force in response to human rights violations, in exchange for relinquishing the sovereignty of states, but the repeated use of it recently and its selective application led to the idea being taken away from its legal and legitimate direction, so it was a violation of humanity and collective security in a way that exceeds the protection guaranteed by the intervening state. Perhaps the standards adopted and the aspirations of political units and decision-makers with their intervention in a compliant manner had a major negative impact on the protection of security and peace in the countries in which they intervened, and thus violated the levels of responsibility to protect, which they were supposed to seek, according to their claim, to achieve based on what they called safe corridors, and this is what we will clarify through this intervention based on the research on the issue of the control of national and international conditions in determining the standards adopted for international humanitarian intervention and researching their reflection in determining Protection responsibility levels.
