الخصوصية الهيكلية لرئيس البلدية التونسي على ضوء مجلة الجماعات المحلية

الملخص
تسعى هذه الدراسة للبحث في الخصوصية الهيكلية لرئيس البلدية في تونس على ضوء الإصلاحات التشريعية التي أقرّتها مجلة الجماعات المحلية، والتي أعادت تحديد موقعه ضمن المنظومة اللامركزية ومنحته دورًا محوريًا في إدارة الشأن المحلي. ويرتكز التحليل على خصوصيته الهيكلية باعتباره الممثل القانوني والمسؤول الأول عن مصالح البلدية، استنادًا إلى مبدأ المشروعية الانتخابية المزدوجة، حيث يتم انتخابه أولًا من قبل المواطنين كعضو في المجلس البلدي، ثم من قبل أعضاء المجلس لرئاسته وفق شروط وإجراءات قانونية دقيقة. وتُبرز الدراسة ما تتيحه هذه المشروعية من تعزيز لاستقلاليته في ممارسة مهامه، من خلال إلغاء أشكال الرقابة السابقة التي كانت تمارسها السلطة المركزية، والاكتفاء برقابة لاحقة تقتصر على شرعية القرارات، كما تتناول الدراسة مبدأ التدبير الحر باعتباره أحد ركائز اللامركزية والديمقراطية المحلية، وما يتيحه من صلاحيات في تسيير شؤونها وإصدار القرارات التنظيمية في حدود القانون.This study seeks to examine the structural specificity of the Mayor in Tunisia in light of the legislative reforms introduced by the Local Authorities Code, which redefined the Mayor’s position within the decentralized system and granted him a pivotal role in managing local affairs. The analysis focuses on his structural particularity as the legal representative and the primary authority responsible for the municipality’s interests, based on the principle of dual electoral legitimacy first elected by citizens as a member of the municipal council, and then by the council members to preside over it, in accordance with precise legal conditions and procedures. The study highlights how this legitimacy enhances his independence in carrying out his duties by abolishing the forms of prior oversight once exercised by the central authority, limiting supervision to subsequent control restricted to the legality of decisions. It also addresses the principle of free administration as one of the pillars of decentralization and local democracy, emphasizing the powers it grants in managing municipal affairs and issuing regulatory decisions within the bounds of the law.
