Administrative Grievance In Algerian Law

Abstract

This study examines the role and evolution of administrative grievance in Algerian law, tracing its transformation from a compulsory procedural step under the repealed Civil Procedure Code (1966–2008) to a discretionary remedy under the Civil and Administrative Procedure Code of 2008. It highlights the legislative fragmentation and institutional ambiguities that have undermined the effectiveness of grievance mechanisms, especially in disputes involving administrative contracts. The article also analyzes the shifting legal requirements for grievance procedures in public procurement, including the role of conciliation committees and their impact on dispute resolution. Based on a critical review of legal texts and jurisprudence, the study concludes with practical recommendations aimed at enhancing the independence, clarity, and efficiency of administrative grievance systems in Algeria.
