Industrial development and globalization have led to the specialization of industries and the widespread adoption of subcontracting and supply chains. As a result, it has become rare for a product to be manufactured entirely in a single location. Consequently, subcontracting relationships and forms have diversified, involving factors such as specialization, production capacity, and both domestic and international subcontracting. This has significantly impacted the nature of industrial contracts and the legal standing of the contracting parties. Accordingly, this research paper seeks to examine the legal characterization of industrial subcontracting contracts, given their various forms and the differing interpretations of the concept—ranging from a narrow legal perspective limited to subcontracting, to a broader economic view based on a distinctive contractual relationship involving multiple parties.
