Freedom Of Expression In International Conventions And Algerian Legislation – Media Legitimacy Between Freedom And Legal Responsibility

Authors : Youssouf Megarin .

Abstract

The Algerian legislator has enshrined the principle of the constitutional right to freedom of expression, supplementing it with legal and procedural safeguards to ensure its practical implementation. This framework aims to protect the individual's human dignity and uphold media, religious, and moral freedoms—within the boundaries imposed by respect for national security, state sovereignty, and territorial integrity. Reflecting this vision, this approach embodies the Algerian legislator's commitment—amid the construction of the "New Algeria"—to guaranteeing and regulating fundamental individual rights, with a particular emphasis on safeguarding freedom of expression. This right was explicitly granted constitutional status under Article 54 of the 2020 Algerian Constitution. Furthermore, the Algerian legislator has criminalized all forms of expression that involve blatant violations of national security, sovereignty, or territorial unity, seeking to preserve public interest and social cohesion. Thus, it can be said that Algeria’s constitutional framers have achieved a notable balance in establishing a precise legal equilibrium—one that delineates the boundary between exercising the right to free expression and the accompanying limits of responsibility.
