اشكالات اسناد المسؤولية الجنائية في جرائم الذكاء الاصطناعي

الملخص
لقد ادى الانتشار الواسع لاستخدامات الذكاء الاصطناعي لإحداث ثورة صناعية رابعة معتمدة على تطورات تكنولوجية هائلة، حيث اصبح الذكاء الاصطناعي و البشري يشكلان تحديا للقانون الجنائي و في مقابل ذلك احدث العديد من الاشكالات القانونية لاسيما في قواعد المسؤولية الجنائية، ففي حال ارتكاب كيانات و انظمة الذكاء الاصطناعي لجرائم يستلزم الامر البحث في كيفية اسناد المسؤولية الجنائية ،و الاسس المعتمدة في ذلك سواء كانت ناتجة عن اخطاء الذكاء الاصطناعي المرتكبة بصفة عمدية او غير عمدية هذا في ظل انعدام نصوص قانونية تعالج هذا النوع من المسؤولية The widespread spread of the uses of artificial intelligence to create a fourth industrial revolution based on tremendous technological developments, where artificial and human intelligence has become a challenge to criminal law and in exchange for that the most recent of many legal problems, especially in the rules of criminal responsibility, in the event that the entities and systems of artificial intelligence are committed for crimes that requires researching how to assign criminal responsibility, and the foundations It is approved in that, whether it is caused by the errors of artificial intelligence committed in a intentional or non -intentional capacity, in light of the lack of legal texts that address this type of responsibility
