Expropriation Of Private Property For Public Interest In The Algerian Legislation

Authors : Touaibia Hassen .

Abstract

The article discusses two important constitutional principles that may appear conflicting but are, in fact, complementary: the principle of the citizen’s right to private property and the State’s right to expropriate private property for public interest. The law has established specific procedures and stages that the administration must follow for the expropriation of private property to be lawful. The first of these procedures is to notify citizens of the existence of a project serving the public interest, whether directly—such as opening a road, building a hospital, or constructing a sports stadium—or indirectly, such as establishing an administrative facility that serves citizens’ needs. To protect citizens from potential administrative abuse, the law ensures that expropriation procedures are subject to judicial oversight, specifically by the administrative judge, who is legally authorized to adjudicate disputes involving the administration, pursuant to the organic criterion. Furthermore, the law safeguards the citizen by requiring that expropriation of private property be accompanied by fair compensation, which is also subject to review by the administrative judiciary, given the possibility of the administration acting arbitrarily in its assessment of fair compensation, to the detriment of the expropriated citizen.
