18. Abstract : This study focuses on highlighting the impact of Algeria’s international commitments in the field of combating organized crime and corruption on the development of its domestic legislation. Algeria ratified the United Nations Convention against Transnational Organized Crime in 2000 through Presidential Decree No. 02/05 of 02/02/2002, and subsequently ratified the United Nations Convention against Corruption of 2003 on 19/04/2004, in addition to its accession to the Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances. These ratifications led to substantial amendments to the national legal framework in order to harmonize it with the provisions of these international instruments. Among the most significant developments was the introduction of the investigative technique of “infiltration” (infiltration technique) for the first time in Algerian legislation under Anti-Corruption Law No. 06/01 of 20 February 2006, whereby Article 56 authorized the use of special investigative methods such as controlled delivery, electronic surveillance, and infiltration, subject to prior authorization by the competent judicial authority. However, the legislature did not at that stage provide a clear definition of infiltration nor specify the modalities of its implementation, which rendered the measure practically inoperative until the amendment of the Code of Criminal Procedure by Law No. 06/22 of 20/12/2006, which explicitly introduced the notion of “infiltration” and detailed its rules under Articles 65 bis 11 to 65 bis 18.
