أليات التقاضي لحل النزاعات التجارية في التشريع الجزائري

الملخص
سعى المشرع الجزائري الى القيام بعدة إصلاحات تشريعية شملت مختلف مجالات التنمية الاقتصادية بغية ترسيخ مبادي حرية التجارية ، فمن بين المحاور التي أولى لها المشرع اهتمام جدير عكست ارادته في تحقيق أهداف المشروع التنموي ، الإصلاحات التشريعية المتعلقة بحل النزاعات القضائية التجارية . من هذا المنطلق اتخذ المشرع خطوات بناءة تهدف الى تكريس القضاء التجاري المتخصصـ للنظر و الفصل في مختلف الخصومات القضائية التجارية ، التي مما لا شك فيه أثر مباشر على استقرار المعاملات التجارية والحفاظ على حقوق المتخاصمين . The Algerian legislature has sought to carry out a number of legislative reforms covering various areas of economic development in order to consolidate the principles of free trade. Among the areas to which the legislature has paid due attention, reflecting its desire to achieve the objectives of the development project, were legislative reforms relating to the resolution of judicial commercial disputes. With this in mind, the legislator took constructive measures to establish a specialised commercial judiciary to examine and settle various judicial commercial disputes, which undoubtedly had a direct impact on the stability of commercial transactions and the preservation of the rights of the parties.
