الملخص
دخول الاجانب إلى الجزائر، مسألة سيادية ، لذا يعد تنظيمه مظهرا من ظاهر فرض الدولة لسيادتها على اقليمها، وهو أمر تولاه المشرع بموجب القانون رقم 08-11، المؤرخ في 25 يونيو 2008، المتعلق بشروط دخول الأجانب إلى الجزائر واقامتهم بها وتنقلهم فيها، حيث بين الاجراءات الواجب مراعاتها من أجل دخول الأجنبي إلى الجزائر بشكل قانوني ، تفاديا لهجرته غير الشرعية إليها، كما نظم المركز القانوني للأجانب المتواجدين فوق الاراضي الجزائرية مبينا حقوقهم والتزاماتهم ومختلف الاجراءات القانونية التي قد تتخذ في حقهم ، مهما كانت وضعيتهم القانونية خلال فترة تواجدهم فيها، سواء كمقيمين بشكل قانوني عليها، أو بصورة غير شرعية . وإذا كان غرض المشرع من رواء هذ التنظيم هو الحد من ظاهرة الهجرة غير الشرعية إلى الجزائر لاسيما من دول الساحل الافريقي، إلا أنّ هذا التنظيم لا يخلو من بعض الثغرات التي يمكن تداركها بتعديل بعض من مواده واعادة صياغتها. The entry of foreigners into Algeria is a sovereign issue. Therefore, its regulation is a manifestation of the state's assertion of sovereignty over its territory. This is a matter addressed by the legislature under Law No. 08-11, dated June 25, 2008, concerning the conditions for the entry, residence, and movement of foreigners into Algeria. The law outlines the procedures that must be observed for a foreigner to enter Algeria legally, to avoid illegal immigration. It also regulates the legal status of foreigners present on Algerian territory, outlining their rights and obligations and the various legal measures that may be taken against them, regardless of their legal status during their stay, whether as legal residents or illegal residents. While the legislature's objective in enacting this regulation was to curb the phenomenon of illegal immigration to Algeria, particularly from the Sahel countries of Africa, this regulation is not without some shortcomings that can be remedied by amending and redrafting some of its provisions.
