Abstract: Algeria’s Regulation 20/02 on Islamic banking operations introduces a set of novel contractual forms, chief among them the murābaḥah sale, with the declared aim of drawing upon Islamic legal principles—most visibly by excluding interest—to structure financial transactions. Yet that ambition remains only partially fulfilled. Classical Islamic jurisprudence regulates murābaḥah through a lattice of purposes and precise Sharīʿah conditions that diverge, both in form and substance, from the framework of positive law and, in particular, from the civil-law rules governing commercial exchanges. The result is a hybrid arrangement: the murābaḥah contract has been grafted onto Algeria’s legal system while profound normative differences persist and while the regulatory text itself displays notable lacunae. Key Sharīʿah requirements—such as the obligation of parity (tamāthul) in certain types of commodities—are omitted; other matters, including the purchaser’s prior acquisition and actual possession of the goods before resale, are left ambiguous; some provisions even contradict one another.
