Abstract

Abstract: Avoiding the risks associated with banking operations can only be achieved by regulating and framing the supervising bodies, limiting them to a circle of institutions subject to state intervention through regulation and supervision. This is aimed at preventing the severe effects that could arise from such institutions facing crises that affect the entire state's financial and economic system, potentially causing irreparable losses. This led to what is known as the monopoly of banks and financial institutions on banking operations, where related legal texts have worked on imposing, controlling, and regulating it, as well as imposing legal protection at its highest degree, which is criminal protection, by criminalizing other entities from practicing such operations that are exclusively reserved for certain entities.
