Towards Employing Maqasid Of Shariah In Wealth And Business In Contemporary Islamic Financial Products (the Mechanism Of Islamic Securitization As A Model)

Abstract

The study explores the importance of employing the maqasid of Shariah in wealth and business within the structure of contemporary Islamic financial products. After a simplified presentation of the maqasid of Shariah in wealth and business and their forms, and an explanation of the manifestations of their realization in the mechanism of Islamic securitization, relying on descriptive and inductive approaches, the study concludes that taking into account the extent to which of the maqasid of Shariah in finance and business are realized in Islamic financial products has become an absolute necessity for the Islamic finance sector, as it will contribute to rehabilitating the true role of that sector by deepening the economic, social and financial impact of its products. It also increases acceptance and expands the circle of interest and demand for contemporary financial instruments and products, based on the positive impact of those maqasid in the living reality. تهتم الدراسة ببحث أهمية توظيف مقاصد الشريعة في المال والأعمال في هيكل المنتجات المالية الإسلامية المعاصر. وبعد عرض مبسط حول مقاصد الشريعة في المال والأعمال وصورها، وبيان مظاهر تحقّقها في آلية التصكيك الإسلامي، وذلك بالاعتماد على المنهجين الوصفي والاستقرائي، خلصت الدراسة إلى أن مراعاة مدى تحقق مقاصد الشريعة في المال والأعمال في المنتجات المالية الإسلامية أصبحت ضرورة حتمية على قطاع المالية الإسلامية لأنه سيسهم في إعادة تأهيل الدور الحقيقي لذلك القطاع من خلال تعميق الأثر الاقتصادي والاجتماعي والمالي لمنتجاته، ولأنه أيضا يزيد من قبول وتوسيع دائرة الاهتمام والطلب على الأدوات والمنتجات المالية المعاصرة، اعتبارا من الأثر الإيجابي الذي يمكن أن تحدثه تلك المقاصد حال تحقّقها في الواقع الحي.
