Authors : Bezzahi Saloua .

Abstract

Abstract : Environmental litigation in France is becoming a central area of law, facing global ecological challenges. It involves various disciplines such as administrative, criminal, and civil law, and relies on principles like the precautionary principle and the polluter-pays principle. Landmark cases, such as the "Affaire du Siècle," highlight the climate emergency and the state's responsibility. The role of judges and participatory mechanisms is strengthening, while the recognition of the right to a healthy environment marks a significant advancement. This litigation represents a necessary shift to reconcile economic development with environmental protection.
