Article abstract: Striking a balance between parliamentary immunity and the principle of equality before the law has led most legal systems to recognize the necessity of removing this obstacle through procedures established by internal regulations and parliamentary bylaws. However, the principle of parliamentary solidarity, upheld by legislators to shield themselves from judicial rulings, has led some legal frameworks to abandon the requirement of prior authorization for criminal prosecution. In Algeria, the constitutional legislator, under the 2020 Constitution, introduced a different approach from previous constitutions by entrusting the Constitutional Court with the authority to lift parliamentary immunity. This shift ensures a degree of independence, impartiality, and objectivity in decision-making.
