مشروعية القرارات الإدارية الصادرة بواسطة الذكاء الإصطناعي

الملخص
الملخص: في ظل التحول التكنولوجي و انتشار استخدام أنظمة الذكاء الاصطناعي، بدأت الإدارة العامة في توظيف هذه التقنيات في نشاطها بغرض إصدار قرارات إدارية، وهو ما يثير إشكالات قانونية متعددة تتعلق بمشروعية هذه القرارات ومطابقتها للنصوص القانونية التي تنظم القرارات الإدارية التقليدية. تهدف هذه الدراسة لتسليط الضوء على الإطار القانوني المنظم للقرارات الإدارية المؤتمتة، وما إذا كانت تتوافق مع مبادئ المشروعية. وتكمن أهميتها في كونها تمس مجالًا مستحدثًا يطرح تحديات نظرية وعملية في مجال القانون الإداري، وتبرز الحاجة إلى تكييف القواعد القانونية مع الواقع الرقمي الجديد. وقد خلصت الدراسة إلى أن غياب تأصيل قانوني واضح لهذه القرارات قد يؤدي إلى المساس بمبدأ المشروعية، وأن هناك ضرورة ملحة لتقنين استخدام الذكاء الاصطناعي في المجال الإداري، من خلال إدراج ضمانات قانونية تحيط بمراحل اتخاذ القرار وتخضعه لرقابة فعالة تكفل عدم تعسف الإدارة تحت غطاء التكنولوجيا. Abstract: Amid the technological shift and the widespread adoption of artificial intelligence systems, public administrations have begun employing these technologies in their operations to issue administrative decisions, thereby raising multiple legal questions concerning the legality of such decisions and their consistency with the statutory provisions governing traditional administrative acts. This study seeks to shed light on the legal framework regulating automated administrative decisions and to assess their compliance with the principles of legality. Its significance lies in addressing an emerging field that poses theoretical and practical challenges within administrative law, underscoring the need to adapt existing legal norms to the new digital reality. The study concludes that the absence of a clearly defined legal foundation for these decisions may undermine the principle of legality, and that there is an urgent need to codify the use of artificial intelligence in the administrative sphere by embedding legal safeguards throughout the decision making process and subjecting it to effective oversight to prevent administrative arbitrariness under the guise of technology.
