كبرى الاتجاهات الفقهية الحديثة وأثرها على المعاملات المالية المعاصرة (التأمين التجاري - أنموذجا-)

الملخص
الملخص: يهدف هذا المقال إلى إلقاء الضوء على أهمية معرفة الاتجاهات الفقهية المعاصرة، واعتبارها في مراحل عملية الاجتهاد، وتنزيل الأحكام في المسائل المستجدة، مع تطبيق عملي لها على معاملة من المعاملات المالية المعاصرة، وهي التأمين التجاري، وذلك من خلال بيان مفاهيم تلك الاتجاهات، وأنواعها وعرض خصائصها، وذكر أهميتها، وبذلك يمكن بناء العملية الاجتهادية وفق رؤية موضوعية تراعي السياقات التاريخية للعمليات التشريعية، وتحقق مقصد الشارع من تشريع الأحكام. وكان من نتائج هذا العمل؛أن معرفة الاتجاهات الفقهية المعاصرة يشكل ركيزة هامة في بناء التصورات الصحيحة للقضايا الكبرى للأمة، كما لها دور في توجيه عملية تنزيل الأحكام على المسائل المستجدة، كما أن الاجتهاد الفقهي المعاصر ينبني على ثلاثة اتجاهات فقهية حديثة بارزة ،كانت نتاجا للتغيرات المختلفة الحاصلة في جميع المجالات في حياة المجتمعات الإسلامية. Abstract: This research paper aims to shed light on the importance of knowing contemporary Fiqh trends, considering them at the stages of the Ijtihad process, and downloading rulings on emerging issues, by explaining the concepts of those trends, their types, presenting their characteristics, and mentioning their importance, so that the Ijtihad process can be built according to an objective vision that takes into account the historical contexts of legislative processes, and achieve the purpose of the street legislation provisions. One of the results of this paper was that knowledge of contemporary Fiqh trends is a general framework and an important pillar in building the correct perceptions of the major issues of the nation, and it also has a role in guiding the process of downloading judgments on emerging issues, and it was decided that contemporary Fiqh jurisprudence is based on three modern Fiqh trends that were the product of various changes taking place in all areas in the life of Islamic societies
