الايداع الالكتروني للدعوى الادارية في الجزائر بين الموجود و المنشود

الملخص
يعالج المقال موضوع الايداع الالكتروني كواحد من مظاهر الثورة الرقمية التي يشهدها مرفق القضاء الاداري في الجزائر، بموجب التعديل الاخير لقانون الاجراءات المدنية و الادارية. حيث يهدف المقال للبحث فيما لدى المشرع الجزائري بخصوص الية الايداع الالكتروني للدعوى الادارية، بالإضافة لما هو منشود، انطلاقا من عرض و تحليل التجربة الجزائرية ومقارنتها بتجارب الدول الرائدة في مجال رقمنة الايداع الالكتروني للدعوى الادارية من أجل الوقوف على مواطن القصور، وإبراز التحديات التي تواجه تطبيق هذه الالية واقتراح طرائق لتطويرها و تفعيلها لتحقق الغرض الذي وجدت لأجله . The article undertakes the issue of electronic filing as one of the manifestations of the digital revolution currently taking place in the administrative judiciary system in Algeria, pursuant to the recent amendment of the civil and administrative procedure code. It aims to examine the current legislative framework governing the electronic filing of administrative lawsuits in Algerian law, as well as the aspirations in this regard. This is done through the presentation and analysis of the Algerian experience and its comparison with the experiences of leading countries in the field of digitalization of electronic filing for administrative lawsuits. The objective is to identify shortcomings and the challenges hindering the implementation of this mechanism and to propose methods for its development and activation in order to fulfill the intended purpose.
