التدابير الوقائية كآلية لتحصين المرفق العام من ظاهرة الفساد

الملخص
Abstract : The Algerian legislator, in the context of its protection of public funds, has put in place several measures to confront the phenomenon of corruption that plagues public institutions and contributes to the squandering of public funds. In this context, the laws related to public utilities, especially the General Basic Law of the Civil Service, as well as the Anti-Corruption Law, and the law specifying the general rules related to public contracts, came with a set of precautionary or proactive measures that enshrine transparency in administrative transactions. The Algerian legislator is also keen to take all means that allow for the protection of public funds by enhancing the manifestations of transparency in all administrative aspects, especially in light of the rapid trend towards digitization of all public utilities. ملخص إن المشرع الجزائري وفي إطار حمايته للمال العام وضع عدة تدابير لمواجهة ظاهرة الفساد التي تنخر المؤسسات العمومية وتساهم في إهدار الأموال العمومية، وفي هذا الإطار جاءت القوانين ذات الصلة بالمرافق العمومية خاصة القانون الأساسي العام للوظيفة العمومية، وكذا قانون مكافحة الفساد، والقانون المحدد للقواعد العامة المتعلقة بالصفقات العمومية بجملة التدابير الاحترازية أو الاستباقية التي تكرس الشفافية في المعاملات الإدارية، كما أن المشرع الجزائري على اتخاذ كل الوسائل التي تسمح بحماية المال العام من خلال تعزيز مظاهر الشفافية في كل الجوانب الإدارية، خاصة في ظل التوجه السريع لرقمنة كل المرافق العمومية .
